Tree Removal Permits in Coral Gables

In Coral Gables the tree permit does not begin at removal. It covers modifying a tree, and it covers pruning a limb of ten inches or more in diameter. On a mature canopy that is a size reached during ordinary maintenance, so work you would schedule as trimming is work the city treats as permitted. TWQ Landscaping prepares and files these applications, and our ISA Certified Arborist (NY-6948A) produces the supporting report where one is required.

Does This Apply to Your Property?

Section 82-29 of the Code of Ordinances reaches any tree, so a commercial site, an association common area, a condominium parcel, a hotel or an institutional campus is inside it on the general terms. There is no size threshold to fall under and no property type that sits outside.

The residential position runs through the county rather than the city. Miami-Dade Section 24-49(4)(a) exempts trees in the yard area of an existing single-family residence, provided they are not specimen trees and not in a natural forest community, and that exemption does not reach trees in the county right of way. We searched the Coral Gables tree and landscape chapters and found nothing stricter, though a municipality may be stricter and several in Miami-Dade are, so the city is worth a call before relying on it for a house.

What Needs a Permit

Section 82-29 makes it unlawful to modify, cut down, destroy, remove or move a tree, to effectively destroy it through damaging, or to authorize any of those things, without a permit. Two words there matter more than the rest. Modify means the section is not only about taking a tree down. Authorize means that instructing a contractor is covered as well as doing the work, so a board that approves a scope of work is inside the section.

Section 82-29(d) adds pruning: a limb of ten inches or more in diameter on private property requires a tree permit from the tree preservation agency. That is a routine size on a mature oak or ficus, and it applies on private property, not only in the right of way.

Tree abuse is prohibited in its own right, and where an act of abuse leaves a tree nonviable, the code calls that effective removal and requires the owner to comply as though the tree had been taken down without a permit. In practice that means a badly executed trim can be treated as an unpermitted removal.

What It Costs

The permit itself is inexpensive and the mitigation is not, so budget the second rather than the first. The published Coral Gables Fee Schedule sets removal at $35.00 for the first tree and $10.00 for each additional tree on the same application. A permit appeal is $100.00.

Mitigation is the number that decides a budget, and Coral Gables has two official amounts for it. The ordinance at Section 82-39(b) sets trust fund contributions at $2,500.00 for every 500 square feet or portion thereof of replacement tree coverage. The city Fee Schedule states $1,500 for the same 500 square feet. The ordinance allows amendment by resolution, so the schedule may be current, but neither document says so. We confirm the operative rate with the city before quoting, because across a large canopy the two figures produce very different totals.

Two things reduce the bill. An administrative tree variance that does not exceed 20 percent of the minimum code requirement, approved by staff under Section 82-33, carries no charge at all, while a variance that has to reach the Board of Adjustment is $913.50. And no fee is charged for trees that are relocated rather than removed, or that sit in a utility easement and have to come out to bring service to the property.

What Happens If It Is Done Without a Permit

Section 82-37 provides for a fine up to $1,000.00 for a first violation or $5,000.00 for repeat violations, or up to 60 days in the county jail, or both, at the discretion of the code enforcement board. Each tree cut down, destroyed, removed or moved counts as a separate offense, and Section 82-38 extends that counting to each shrub, orchid and vine.

The exposure rises sharply for a specimen tree on city property or in the right of way. A willful act to injure or move one without prior approval carries up to $15,000.00 per offense, and the city may additionally sue for the monetary value of the tree and recover its attorney fees. Section 82-38 also allows damages and injunctive relief, which the section says the court shall expedite.

Several charges on the city civil penalty schedule need no tree work at all. Failing to place protective barriers around a tree, a cluster of trees or the edge of a preservation area is $200.00. Putting injurious substances on or near tree roots is $500.00, and so is disturbing the roots of any tree, shrub or vine in a public highway or park without a permit. Violating the terms of a permit already issued is $5,000.00 per offense. These are the ones incurred during construction, irrigation and hardscape work on a property that happens to have trees on it.

What to Check With Your Contractor

Coral Gables licenses and polices the trade directly, so a contractor working your property carries obligations of their own. Landscape maintenance contractors, tree trimmers and gardeners must register each vehicle with the city at $5.00 per vehicle per year, and a registration violation costs $50.00 for the first in a twelve month period and $100.00 for the second. Section 82-7 then sets out in detail how and where those vehicles may park while working in residential areas, including a minimum nine foot travel lane, a six cone layout around the vehicle, and no parking within 75 feet of an intersection.

What to Do Next

Before any tree work is scheduled in Coral Gables, three things are worth settling. Whether the work you have in mind crosses the ten inch pruning threshold or counts as modification. What the mitigation will be, at the rate the city is currently applying rather than the one in the code. And whether any tree in scope sits in the right of way or is a specimen, because that is where the penalties change scale.

We settle all three before quoting. We inspect the trees, document species, size and condition, prepare the arborist report where the application calls for one, file the permit, install protection barriers to the standard the penalty schedule expects, and handle replacement planting where mitigation applies. TWQ Landscaping handles tree permitting for the properties we maintain across Broward, Palm Beach and Miami-Dade: community associations and condominiums, commercial and industrial sites, medical and senior living campuses, schools, religious campuses, hotels, multifamily rental, self-storage, dealerships, retail outparcels, marinas, mobile home communities, municipal grounds and mixed-use.
