Tree Removal Permits in Oakland Park

In Oakland Park a tree crew's authority starts with the property owner. Section 8-25 of the Code of Ordinances makes it unlawful for any person to remove or cause to be removed from any real property within the city any soil, subsoil, rock, sand, trees or shrubbery. Its proviso covers the owner, and covers any person removing with the written consent of the owner. Written consent, signed by the owner, is the document. TWQ Landscaping prepares and files these applications, and our ISA Certified Arborist (NY-6948A) produces the supporting report where one is required.

Does This Apply to Your Property?

Section 8-25 is written against any person and any real property within the city. A condominium parcel, an association common area, a commercial site, an industrial yard or an institutional campus is read against the same text. Section 13-17 is framed the same way. It binds any individual or company doing work on private property, alongside the trades it names by title. The duties set out below travel with the work rather than with the property type.

Oakland Park holds a certified tree ordinance and enforces it in lieu of county enforcement, and the city appears on the county list of certified municipalities. That makes the city the authority you apply to for tree work rather than the county. Certification is not permanent, and our Broward County guide covers the county layer sitting behind it. For an Oakland Park property, the practical consequence is that the application and the fee are the city's to state.

The residential position runs through the county code. Broward County Section 27-408(a)(3)(c) carries the exemption written for owner-occupied detached single-family and duplex property. Its conditions, and the tree categories it holds back, are set out in the Broward County guide. Certified municipalities administer their own program and may be stricter than the county, so which rule governs a particular house is settled with Oakland Park before anyone advises a homeowner.

What Needs a Permit

Two obligations are settled in the sections read for this page, and the removal permit itself is settled with the city. The first is the consent rule, and it reaches further than the crew. Section 8-25 covers removing and causing to be removed, so the board or the manager who instructs a contractor is inside the section alongside the contractor. The proviso is written around a document, which is why the consent is collected before the work rather than reconstructed after it.

What Oakland Park settles is the removal permit and what triggers it. The city administers its own certified ordinance, so the trigger, the application contents and the fee are established with the city for the specific tree and the specific parcel. We put that question to Oakland Park before a scope of work is priced, rather than carrying an assumption into a board budget and correcting it later at the association's cost.

What It Costs

The number that decides an Oakland Park budget is the one the city holds. The fee for the removal permit, and the amount attached to an enforcement action, both sit with the city rather than in the sections read for this page. We confirm each of them with Oakland Park before quoting, because a board is better served by the city's own figure than by an estimate of ours.

What is settled is how the debris leaves the property, and on a mature removal that is a haul line rather than a collection line. Section 13-22, the bulk trash collection service section, states that tree trimmings and branches shall not exceed eight feet in length or eight inches in diameter. Material above either limit is cut down further or hauled. Both of those are labor and disposal, and both belong in the price rather than in a change order raised on the second day.

Section 13-17 puts the cost of clearing the site on the company that did the work. It is the responsibility of tree surgeons, tree trimmers, nurseries and landscaping contractors, lawn maintenance, and any individual or company doing work on private property, to remove from the premises all rubbish resulting from such work. A quotation that stops at felling leaves the association holding a duty the code assigns to the contractor.

What Happens If It Is Done Without a Permit

The enforcement route Oakland Park runs for tree work, and the amount that travels with it, are settled with the city. The sections read for this page carry the duties rather than the schedule, so we ask the city for the route and the figure before a scope of work is priced.

Two exposures are settled in the code, and they stand whichever way the permit question lands. Section 8-25 makes removing or causing the removal of trees or shrubbery unlawful, and its proviso covers the owner and covers any person holding the owner's written consent. It reaches the party who causes the removal as well as the party holding the saw, so the instruction itself is inside the section. Section 13-17 then makes rubbish left on the premises a breach by the company that did the work.

What to Check With Your Contractor

Written consent first. Section 8-25 names the owner of the real property as the party whose written consent counts, so that is the signature to collect, and it is collected before the crew is scheduled. For an association that means settling who the owner of record is for the parcel the tree stands on, and holding a signed document from that party. Ask your contractor to show you what they are working from before the work starts.

Debris second. Section 13-17 names fence companies, tree surgeons, tree trimmers, nurseries and landscaping contractors, lawn maintenance, and any individual or company doing work on private property. It makes all of them responsible for removing from the premises all rubbish resulting from such work. The same section keeps lawn trash and grass clippings off the paved street abutting the property and off adjacent property, so clippings blown into the road are inside it.

Sizing third. Where material is going out for bulk collection, Section 13-22 holds tree trimmings and branches to eight feet in length and eight inches in diameter. Ask how the contractor intends to handle trunk wood and large limbs from a mature removal, because that material is cut down further or hauled. The answer changes the price, the number of days on site, and how the property looks between the felling and the final clearance.

What to Do Next

Three things are worth settling in Oakland Park before tree work is scheduled. What the city requires for the removal itself and what it charges for the permit. Who signs the written consent under Section 8-25, and that it is dated before the crew arrives. And how the debris leaves the property, given that bulk collection takes tree trimmings and branches at eight feet in length and eight inches in diameter.

We settle all three before quoting. We inspect the trees, document species, size and condition, put the permit and fee question to the city for the specific parcel, prepare the arborist report where the application calls for one, collect the owner's written consent, and haul the material that sits outside the bulk collection sizing.
