Tree Removal Permits in Sunrise
Sunrise draws a line that catches maintenance rather than removal. Section 16-173 defines tree abuse to include pruning that reduces the height or spread of a tree that has not attained a height or spread of thirty feet. A size reduction on a young or mid-size tree sits inside that description however cleanly it is cut, and a crew can commit it while believing it is doing careful work. TWQ Landscaping prepares and files these applications, and our ISA Certified Arborist (NY-6948A) produces the supporting report where one is required.
Does This Apply to Your Property?
Sunrise holds a certified tree ordinance and enforces it in lieu of county enforcement, so the city is the authority you apply to rather than the county. That certification is not permanent, and our Broward County guide sets out what sits behind it and what stays with the county regardless. The tree abuse provisions at Section 16-173 are written about the act rather than about the owner, so a condominium parcel, an association common area, a commercial site or an institutional campus is read against the same definitions.
The residential position runs through the county. Broward County Section 27-408(a)(3)(c) exempts removal of any tree on owner-occupied residential property of one acre or less developed for detached single-family or duplex use, and previously preserved or replaced trees stay outside that exemption, as do historical and specimen trees. Certified municipalities administer their own program and may be stricter than the county, so which rule governs a particular house is worth settling with Sunrise before a crew is booked.
What Needs a Permit
The trigger attaches to the activity rather than to the tree. Section 16-172 requires a tree removal permit as a condition precedent of any land clearing or site development where any tree removal or relocation is to be conducted, except as the section otherwise exempts. So the question to answer first on a Sunrise site is what the work is classed as, because a scope that reads as land clearing or site development brings the permit with it.
There is a faster route where a site qualifies for it. Any person may submit a sworn affidavit to the city stating that the property they wish to develop does not contain trees that are protected under the section. That is an alternative to producing a survey, and it is sworn, so it rests on the identification being right. The city may conduct a review or a site inspection whichever route is used, so an affidavit is a shortcut through the paperwork rather than through the inspection.
The survey requirement has a boundary of its own at five trees. The section provides that in no case shall a tree survey be required when the property contains five or less trees. On a small parcel that is worth establishing early, because it changes what a proposal has to include before an application can go in.
What It Costs
The larger exposure in Sunrise is not the permit. Section 16-167 gives the city the right to initiate the removal of any dead or diseased trees on private property when they constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the city. On written direction from the department, the code enforcement officer notifies the owner in writing, and removal is done by the owner, at their own expense, within twenty-one days after the date of service of notice. That is a compressed schedule on an unbudgeted job, and it arrives without warning.
The stump requirement inside that section is the part that gets under-quoted. All stumps are removed below the surface of the ground. A proposal written to cut flush does not meet it, and the difference is grinding equipment and time rather than a detail.
The permit application filing fee exists and its amount is set outside the code text, so we obtain the current figure from the city before quoting. Three conditions attach to it and each one can cost money on a project that changes shape. The fee is tendered before an application is accepted for review. It is not refundable, and it may not be applied to any permit application other than the one it was originally paid for. And for any substantial deviation from the original application there is an additional fee, so a scope that moves after filing pays twice.
What Happens If It Is Done Without a Permit
What Sunrise assesses for a violation was not located in the sections we read, so we do not put a number in front of a board and neither should anyone else. We confirm the current exposure with the city before work is scheduled. What is established is that tree abuse is prohibited in its own right at Section 16-173, separately from the permit, which means a job that needed no permit at all can still produce a violation on the strength of how the cutting was done.
What to Check With Your Contractor
Section 16-173 defines the terms rather than leaving them to judgment, and the definitions are worth reading against a proposal. Hatrack means to sever the leader or leaders, or to prune a tree by stubbing of mature wood. Prune or trim means to cut away, remove, cut off or cut back parts of a tree. Tree abuse then covers hatracking a tree, cutting upon a tree which destroys its natural habit of growth, and pruning that leaves stubs or results in a flush cut or splitting of limb ends.
The thirty foot rule is the one to raise before a maintenance contract is signed. Pruning that reduces the height or spread of a tree that has not attained a height or spread of thirty feet is tree abuse. A great deal of ordinary size management on younger stock falls inside that, so a specification written for another city can produce a violation here unchanged.
Three further limbs of the definition reach technique directly. Peeling or stripping of bark counts, and the section fixes the measure: removal of bark to the extent that if a line is drawn at any height around the circumference of the tree, over one third of the length of the line falls on portions where bark no longer remains. The use of climbing spikes, nails or hooks is abuse except for the purpose of total tree removal or as specifically permitted by the American National Standards Institute. And pruning that does not conform to standards set by the American National Standards Institute is abuse in its own right, which makes the standard a proposal is written to a compliance question rather than a preference.
What to Do Next
Three things settle a Sunrise job before it is priced. Whether the scope reads as land clearing or site development, since that is what brings the permit. Whether the property qualifies for the affidavit route or sits under the five tree survey boundary. And whether any tree in a maintenance scope is under thirty feet in height or spread, because reducing one is abuse whatever the cut quality.
We settle those before quoting. We inspect the trees, record species, size and condition, identify protected trees before an affidavit is sworn rather than after, prepare the arborist report where the application calls for one, file the permit, and write the pruning specification to the standard Section 16-173 requires.
